These Terms and Conditions (“Terms”) govern your access to and use of the D-Tagz website and your purchase and use of D-Tagz products.
D-Tagz is a registered assumed name (DBA) of Packs Dealer Tags, LLC, a Tennessee limited liability company. In these Terms, “D-Tagz,” “Company,” “we,” “us,” and “our” refer to Packs Dealer Tags, LLC doing business as D-Tagz.
By accessing this website, placing an order, purchasing a D-Tagz product, or using a D-Tagz product, you agree to these Terms. If you do not agree to these Terms, do not purchase or use D-Tagz products or use this website.
D-Tagz is a dealer plate attachment system designed to assist automotive dealerships and other authorized users with attaching and removing dealer plates from vehicles.
The purchaser and user are responsible for determining whether D-Tagz is appropriate and compatible with the particular vehicle, license plate, mounting location, and intended application.
D-Tagz must be properly installed and used only for its intended purpose. The Company is not responsible for damage, loss, injury, fines, citations, or other consequences resulting from improper installation, misuse, modification, abuse, failure to inspect the product, use of a damaged or excessively worn product, or use for an unintended purpose, to the fullest extent permitted by applicable law.
Purchasers and users are responsible for complying with all applicable laws, regulations, dealership policies, and requirements concerning dealer plates and their use.
All orders must be paid in full at the time of purchase unless D-Tagz expressly agrees otherwise in writing.
D-Tagz reserves the right to refuse, cancel, limit, or decline an order at its discretion, including in cases involving suspected fraud, payment issues, pricing or website errors, product availability, or other circumstances reasonably warranting cancellation.
If D-Tagz cancels an order after payment has been received but before the products have shipped, the applicable amount paid for the canceled products will be refunded.
Prices, quantities, packaging, and product availability may change without notice. D-Tagz reserves the right to correct typographical errors, pricing errors, product-description errors, or other website inaccuracies.
D-Tagz currently ships products only within the United States.
Shipping and delivery dates are estimates unless expressly guaranteed by D-Tagz in writing.
D-Tagz is not responsible for delays caused by shipping carriers, weather, natural disasters, incorrect or incomplete information supplied by the customer, or circumstances outside the Company's reasonable control.
Customers are responsible for providing complete and accurate shipping information.
ALL SALES ARE FINAL.
Due to the nature and intended use of D-Tagz as a consumable product, D-Tagz does not provide a general right of return, exchange, refund, or replacement.
However, D-Tagz may, in its sole discretion, review individual circumstances and voluntarily approve a refund, replacement, exchange, credit, or other accommodation on a case-by-case basis.
Any accommodation provided by D-Tagz is voluntary and does not establish a warranty, course of dealing, continuing obligation, or contractual right to the same or similar accommodation for that customer or any other customer, order, or product.
Products may not be returned without prior authorization from D-Tagz.
Nothing in this section limits any rights or remedies that cannot lawfully be waived or excluded.
D-Tagz products do not include a standard product warranty.
D-Tagz may, at its sole discretion, review an individual product concern and voluntarily provide a replacement, refund, credit, or other resolution. Doing so does not create or establish a warranty or continuing obligation.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, D-TAGZ PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
D-Tagz does not warrant that its products will be suitable for every vehicle, license plate, mounting configuration, mounting location, or application.
Nothing in these Terms excludes a warranty or other right that cannot lawfully be excluded.
The purchaser and user are responsible for proper installation, use, inspection, maintenance, and timely replacement of D-Tagz products.
Before operating or moving a vehicle, the user is responsible for verifying that the dealer plate and all D-Tagz components are properly installed and securely attached.
D-Tagz components should be inspected before use and periodically thereafter. A product that appears damaged, excessively worn, altered, loose, improperly installed, or otherwise unsuitable for continued use should not be used.
To the fullest extent permitted by law, D-Tagz is not responsible for consequences resulting from failure to properly install, inspect, maintain, secure, or replace the product.
Vehicle license-plate mounting configurations, body designs, finishes, materials, accessories, and clearances vary.
The purchaser and user are responsible for determining whether D-Tagz is appropriate for a particular vehicle and for installing and using the product in a manner that avoids damage to the vehicle, license plate, or other property.
To the fullest extent permitted by applicable law, D-Tagz is not responsible for scratches, paint or finish damage, body damage, license-plate damage, mounting-point damage, lost or detached plates, or other property damage resulting from improper installation, misuse, modification, excessive wear, failure to inspect, incompatibility, or use contrary to the product's intended purpose.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, D-TAGZ, PACKS DEALER TAGS, LLC, AND THEIR MEMBERS, OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST SALES, LOST BUSINESS, LOSS OF USE, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO THE PURCHASE, INSTALLATION, USE, MISUSE, FAILURE, OR INABILITY TO USE A D-TAGZ PRODUCT OR THIS WEBSITE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF D-TAGZ AND PACKS DEALER TAGS, LLC ARISING FROM OR RELATING TO A PARTICULAR PRODUCT OR ORDER SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO D-TAGZ FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
These limitations apply regardless of the theory of liability, including contract, warranty, tort, negligence, strict liability, or otherwise, except where such limitation is prohibited by applicable law.
By purchasing, installing, or using D-Tagz, the purchaser and user acknowledge that vehicle accessories and dealer plate attachment systems require proper installation, inspection, maintenance, and use.
The purchaser and user assume the risks associated with improper installation, misuse, unauthorized modification, failure to inspect, continued use after excessive wear or damage becomes apparent, and use on an incompatible vehicle or mounting configuration.
Nothing in these Terms excludes liability that cannot legally be excluded.
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Packs Dealer Tags, LLC, doing business as D-Tagz, and its members, owners, officers, employees, agents, affiliates, contractors, and representatives from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
except to the extent liability cannot lawfully be excluded or shifted.
The D-Tagz name, logos, product designs, website content, photographs, graphics, videos, text, marketing materials, and other proprietary materials are owned by or licensed to Packs Dealer Tags, LLC and are protected by applicable intellectual-property laws.
D-Tagz is associated with U.S. Patent No. 9,242,321 B2.
Nothing in these Terms or the purchase of a D-Tagz product grants a right or license to copy, reproduce, manufacture, reverse engineer, imitate, distribute, commercially exploit, or otherwise use D-Tagz intellectual property except as expressly authorized by Packs Dealer Tags, LLC in writing or otherwise permitted by applicable law.
The D-Tagz website may be used only for lawful purposes.
Users may not interfere with the operation or security of the website, attempt unauthorized access to systems or information, conduct fraudulent transactions, copy or commercially exploit website content without authorization, or use the website in violation of applicable law.
D-Tagz does not guarantee that the website will always be available, uninterrupted, secure, or error-free.
D-Tagz reserves the right to modify, improve, discontinue, or change products, packaging, quantities, pricing, website content, policies, or services at any time, subject to applicable law and obligations relating to orders already accepted.
Product photographs, videos, illustrations, and other representations are provided for informational purposes. Actual products may vary slightly in appearance.
These Terms and any dispute arising out of or relating to these Terms, the D-Tagz website, an order, or D-Tagz products shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles, except where applicable law requires otherwise.
To the fullest extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms, the website, an order, or D-Tagz products shall be brought in a court of competent jurisdiction located in the State of Tennessee, and the parties consent to the jurisdiction of such courts.
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions shall continue in full force and effect.
Failure by D-Tagz to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
A refund, replacement, credit, accommodation, or other exception provided for one customer, product, or order does not waive these Terms or require D-Tagz to provide the same or similar exception in another circumstance.
D-Tagz may update these Terms from time to time.
The version of the Terms in effect when an order is placed will generally govern that transaction, subject to applicable law. The “Last Updated” date at the top of this page indicates when these Terms were most recently revised.
These Terms, together with other policies expressly incorporated into them and any written terms specifically agreed to by D-Tagz, constitute the agreement concerning use of the website and purchase of D-Tagz products.
